Basis of Sale When an order is accepted through our website an agreement is made between you and us for the supply of the goods in accordance with the Terms and Conditions set out below. The quality, quantity and description of goods will be as per those set out on the order form. Plant sizes are approximate. Plants vary in shape, size and colour between different specimens, the information, illustrations and descriptions are for guidance only. Payment. We will charge your credit / debit card in confirmation of your order and delivery date. We accept no liability if delivery of the goods is delayed by the supply of incorrect payment details. Delivery Our aim is to deliver to you as soon as possible. Delivery will be made to the address given with the order, please ensure this is accurate and please also be clear as to where you would like the goods left if you are out when we deliver. We cannot accept any liability for incorrect delivery instructions or damage to the Goods as a result. If delivery is delayed for reasons beyond our control, we will contact you with a new delivery date. Please notify us within 48 hours if the plants are not delivered on the agreed date. Risk and Ownership You become responsible for the Goods at the time they are delivered to you, so any subsequent loss or damage is your own responsibility. You are fully responsible for care, maintenance and the welfare of all plants after delivery. Returns and Cancellations Orders may be cancelled up to the time of payment. All plants are good quality and healthy on leaving the nursery. If you are not happy with the condition of the plants we must be notified within seven days. General Our liability, however arising and including liability for negligence as well as liability under the Terms of the Contract is restricted to the replacement or refund of the goods sold and delivered. We shall not be liable for any other direct or indirect loss suffered by you.
